Supreme Court Ruling Date & Time Announced
An imminent landmark Supreme Court decision is expected to reshape the motor finance industry, and it could unlock billions in compensation for UK drivers mis-sold car finance.
The Supreme Court is preparing to deliver it’s landmark decision this Friday, 1st August at 4.35pm that will impact on the direction of the mis-sold car finance scandal.
At the heart of the scandal is a practice involving undisclosed and unfair commissions. Secret payments were made by car finance providers to dealerships that encouraged them to push costlier finance packages to unsuspecting victims who trusted they were getting the best deal.
The ruling involves two major appeals that challenge whether consumers were treated fairly when car finance dealers received secret or undisclosed commissions from lenders.
Background Of The Case
Brought by Close Brothers and MotoNovo Finance, the appeals aim to overturn an October 2024 Court of Appeal decision that found car dealerships acted unlawfully by failing to fully disclose the amount of commission they earned. The court ruled that this lack of transparency breached fiduciary duties and violated consumer protection law.
If the Supreme Court upholds the Court of Appeals original decision, this would point to the fact that millions of car finance customers were deceived and this may lead to potentially compensation claims. According to industry experts, the total of these claims could reach £44 billion, making it likely to become one of legal and financial history’s largest UK consumer redress cases.
