Your Right To Withdraw
You can withdraw your claim at any stage.
Our service operates on a “no win, no fee” basis, meaning you only pay our fees if we successfully recover compensation for you.
However, if you choose to withdraw your claim before it concludes, you’ll be responsible for covering the reasonable costs of the work we’ve carried out on your behalf up to that point.
This is in line with Solicitors Regulation Authority (SRA) guidance.
How We Calculate Our Costs
We want you to know exactly how our charges work. Our costs are always fair, transparent, and reflect the work done on your file.
- Time is recorded in six-minute “units”.
- Our hourly rate is £175, which equals £17.50 + VAT per unit.
- The minimum cost per file is usually 4 units (£84 including VAT).
Most files involve more work depending on the complexity and number of finance agreements being investigated.
If you decide to withdraw, we’ll calculate the time spent on each agreement and send you a detailed breakdown of costs. Payment is due by bank transfer within 21 days.
What Happens If You Withdraw Your Claim?
If you choose to withdraw your claim:
- We’ll notify your lender(s) that we are no longer acting on your behalf.
- The lender may then close your claim.
Before deciding, we recommend speaking to our specialist motor finance team. We can explain the potential costs and help you make an informed choice.
Why Staying With Bott and Co Could Be The Better Option
Before withdrawing, consider the advantages of keeping your claim with us.
1. “No Win, No Fee” Protection
The FCA have said that they think that just 44% of claims will be successful. If you stay with us and your claim is ultimately unsuccessful, you won’t pay us any costs. By withdrawing now, you risk paying our costs for a claim that might not have won, meaning you could end up paying for our work when you didn’t need to.
2. You Keep Your Place In The Queue
You’ve already made progress. When lenders begin paying out compensation, expected from late 2026 onwards your claim will already be in the system.
If you withdraw now and restart later, your case could move to the back of the queue.
3. Maximising Your Compensation
Our legal experts work to ensure you receive the maximum amount you’re entitled to, even if that means taking your case to court.
4. We Handle Everything for You
We manage the entire process, from gathering evidence to dealing with lenders, so you can relax knowing your claim is in safe hands.
Frequently Asked Questions
Can I withdraw my claim at any time?
Yes, you can withdraw your claim whenever you wish. We’ll always respect your decision.
Will I have to pay anything if I withdraw?
If you withdraw within 14 days, then we will close your file at no cost to you.
If you withdraw after 14 days and before your claim concludes, you’ll be charged for the work carried out so far. Our charges are based on time spent at £175 per hour (charged in 6-minute units at £17.50 + VAT).
What is the minimum withdrawal cost?
The minimum cost per file is £84 (including VAT). However, this may be higher depending on the amount of work completed.
Why do I have to pay if I haven’t received compensation?
Our “no win, no fee” model means we only get paid if we win, but if you withdraw, we lose that opportunity. The withdrawal fee simply covers the time and work already completed.
Can I re-submit my claim later?
Yes, but if you withdraw now and re-submit later, your new claim may go to the back of the queue, delaying any potential compensation.
What if I can’t afford to pay the withdrawal bill immediately?
Please contact motorfinanceclaims@bottonline.co.uk as soon as possible, we’ll work with you to find a suitable solution.
What should I do if I’m unsure about withdrawing?
