Today’s ruling by the European Court of Justice found in favour of millions of delayed passengers as they told the airline KLM that technical problems were not extraordinary circumstances.
Bott and Co had already won a near identical point at the Court of Appeal in 2014 in the case of Huzar v Jet2 but this latest ruling by the ECJ should settle the matter once and for all and cannot be appealed.
It means that 15,000 of Bott and Co’s clients can now receive their rightful compensation of up to €600 each, as per the Regulation EC261/2004, for flight delays of more than 3 hours.
