Every year thousands of people are injured in accidents at work that were not their fault. The law states that if you’ve been injured as a result of an accident that wasn’t your fault then you can receive financial compensation for your pain and suffering and for any other costs you incur such as loss of earnings.
Work Accident compensation is not a way to make money; it is designed to get you back to where you were before the accident happened. The amounts of compensation are set out by the Judicial Studies Board and accepted by insurers and law firms in the UK.

Time Limit For Claiming
The time limit for claiming compensation for an accident at work in the UK is three years from the date of the accident or when you discovered the injury was caused by the accident(which in some cases can be later if the injuries are not immediately diagnosed).
In addition, some workplace injuries can be caused over a period of time because of faulty equipment or inadequate training in which case there is no specific accident date. In these cases we use the date that any injuries were attributed to the work you were carrying out.
What Can I Claim For?
We can recover compensation for your injuries and the pain you’ve suffered and we can also claim for other out of pocket expenses incurred as a result of the accident. This might include:
- Loss of earnings/bonus
- Medical treatment and expenses
- Travel and parking for medical appointments
- Help with day to day activities
- Additional telephone bills
- On-going care and support
We’ve written a comprehensive guide to how much compensation you can claim for an accident at work that has more information. We also have an interactive accident at work calculator for you to use.
The out of pocket expenses are usually referred to as Special Damages while the compensation for your injuries are known as General Damages. Our highly skilled solicitors have experience in dealing with cases that involve:
- Slips and trips at work
- Injuries from work equipment
- Injuries from lifting heavy loads
- Defective machinery or equipment
- Unsuitable equipment (such as scaffolding and ladders)
- Serious head or brain injuries
How Much Can I Claim?
Each case is very different and one of the main elements of our work is to provide a valuation of your claim based on your injuries and any Special Damages that have arisen from the accident and treatment of the injuries.
While Special Damages can be very little in milder injury cases, in severe injuries that leave victims needing on-going care and lifestyle adaptations, these awards can reach into the millions of pounds.
The actual amounts that can be claimed for injuries are set by the Judicial Studies Board and range in value based on the severity of the injury.
We will always look to recover the highest possible amount from the other side. An example of some of the more common workplace injuries is as follows:
|Type Of Injury
||Up To £111,000
||Up To £34,300
||Up To £35,750
||Up To £32,500
|Fracture of Fingers
||Up To £26,250
How Do I Claim?
We are constantly refining our systems to make sure the claiming process is as simple and straightforward as possible for you. The laws around accident at work claims are complex and detailed but our highly experienced and dedicated Employer Liability team are on hand to guide you through the claims process so you don’t need to worry about a thing.
If you have suffered an injury at work you should record the details in the accident book and gather as much information together as possible such as photos of the area in which the accident occurred and details of any possible witnesses to the incident. Read our guide on how to report an accident at work for further information.
If you haven’t already seen your GP or been to hospital then you should get an appointment as soon as possible to make sure the injuries are recorded officially by a medical practitioner as this helps support your claim when we present the evidence to the other side.
Give us a call on 01625 415850 or contact us using the online claim forms and we’ll call you back to go through the claim in more detail and give you free advice on the likelihood of your claim being successful, approximately how much we think it’s worth and whether we can take on your claim on our no-win no-fee basis.

How Long Will It Take?
Claims for compensation for workplace accidents are all very different so it’s difficult to know exactly how long the process will take. If the employer admits liability then the claims are usually settled more quickly. On the other hand, if the employer denies liability then we may have to go all the way to court and this can take much longer.
Once we present the evidence for the claim to the employer, they have up to three months to respond so even in the quickest cases you would expect a settlement in two or three months. Most cases are settled out of court and in several months, but the more complex cases have been known to take over a year to resolve.
What Do I Have To Pay?
You don’t have to pay any up-front costs when you use Bott & Co as your personal injury solicitors. We offer a 100% guaranteed no-win no-fee service so on the rare occasion we aren’t successful in your claim; you won’t have to pay us a penny.
